Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.

Texas State Chapter will be reserving a booth space at the DFW Diwali Mela.

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

Immigration Lawyers Blog Has Just Posted the Following:
On November 27, 2009, the USCIS announced that 58,900 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here...
On November 27, 2009, the USCIS announced that 58,900 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here on out will count toward the regular cap of 65,000. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

hi,
My company allows me to DIY my h1b renewal for my 2nd 3-year term of H1b. My title changed to SENIOR research engineer from research engineer last year. I have the same duty. When I fill out LCA/I129, which should I choose from:
a. New employment:
b. Continuation of previously approved employment without change with the same employer
c. Change in previously approved employment
d. New concurrent employment
e. Change in employer
f. Amended petition
My wage is ok. Are there any potential problems or things I need to pay attention if I file my H1b extension with new title? or it is perfectly ok?

Employer A - LC applied in Dec 07, Currently on 7th year extension till Jan 2010. Stamped visa.
Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2008, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,
Can I get extension on my H1-B beyond APR 2010.
for 1 yr - Based on LC from employer B being pending/approved until Apr 2010
for 3 yr - Based on LC from employer B being approved and I-140 approved.
Apply for premium processing of I-140 before 60 days of Apr 2010 if LC is approved and I-140 is pending.
Your response is appreciated.

Can i cancel appoinment one day before.
I saw in www.vfs-usa.co.in website ,have to cancel before two working days of appointment day.
If i cancel appointmentafter few days will i have to fill again DS156,157 forms for appointment.
In website they said cant cancel appointment 2 times.After 2 times cancelation have to wait 90 days with that hdfc barcode.
Before 90 days period can we fix new appoinment by paying agian into HDFC bank.Is this possible new appointment with new barcode.

i am waiting for my priority date to become current to file for I-485. But it looks it'll take forever, as evident from May 09 visa bulletin, in which the visa dates are unavailable for EB3 India category. Do you know why dates are retrogressing or stagnant in bulletins after bulletins.
I have another question. My birth certificate is in an Indian language which was issued from the panchayat office where I was born. I want to know if that can be translated to English right here in US for I-485 application. Can somebody else who is not related to me write the translation in English and then get it notarized? If this is the case, then I don't have to go to India or get it done from there from the panchayat office, because this may take a long time. If anyone had tackled issues such as this, please share.
